§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers (Section 1 of the Consumer Protection Act) via the online shop of Purogyn GmbH , Münzgasse 2, 5020 Salzburg, Austria (hereinafter referred to as “Purogyn” or “we”).
(2) A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to his or her commercial nor to his or her independent professional activity.
(3) Deviating terms and conditions of the customer will not be recognized unless their validity is expressly agreed to in writing.
§ 2 Subject matter and conclusion of contract
(1) The subject of the contract is the sale of food supplements and related products.
(2) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order.
(3) By clicking the “Buy now” button, the customer submits a binding offer.
(4) The contract is concluded as soon as Purogyn confirms the order by email.
(5) After completion of the order, the contract text including these General Terms and Conditions will be sent by email.
§ 3 Prices, shipping costs and payment conditions
(1) All prices are total prices in euros (€) and include statutory value-added tax.
(2) Shipping costs in addition to the price of the goods will be shown separately during the ordering process.
(3) Payment can be made by
Credit card (Visa, Mastercard)
Instant bank transfer (Klarna / Sofort)
PayPal
Klarna (invoice, installment purchase or immediate payment)
(4) The payment method will be debited upon completion of the order.
(5) The goods remain the property of Purogyn GmbH until full payment has been made.
§ 4 Delivery
(1) Deliveries within Austria and EU member states are made by the shipping service providers specified in the online shop.
(2) The delivery time is – unless otherwise stated in the offer – 2 to 5 working days from receipt of payment.
(3) If a product is not available at short notice, the customer will be informed immediately.
(4) The risk of accidental loss and accidental deterioration of the goods shall only pass to the customer upon delivery.
§ 5 Vouchers
(1) Gift vouchers purchased in the online shop can only be redeemed in the Purogyn online shop at www.purogyn.com .
(2) Vouchers are not redeemable for cash and can only be redeemed before completing the order . Subsequent settlement is excluded.
(3) Vouchers are valid for 36 months from the date of purchase, unless a different validity period is expressly stated. After the expiration date, the right to redemption expires.
(4) Discount vouchers or promotional vouchers issued as part of advertising campaigns are valid until the date specified.
(5) Vouchers can only be used once per order and cannot be combined with other vouchers or discount promotions unless expressly stated otherwise.
(6) If goods for which a voucher was used are returned, no cash payment of the voucher value will be made.
If the entire purchase contract is withdrawn, a new voucher will be issued in the amount of the originally used voucher value.
§ 6 Right of withdrawal (right of cancellation)
(1) Consumers have the right to withdraw from the contract within 14 days without giving any reason.
(2) The withdrawal period shall be 14 days from the day on which the customer or a third party designated by him/her (not the carrier) takes possession of the goods.
(3) To exercise the right of withdrawal, a clear declaration (e.g. by email to info@purogyn.com ) is required.
(4) To meet the deadline, it is sufficient to send the declaration of withdrawal in good time.
(5) In case of withdrawal, all payments including standard shipping costs will be refunded within 14 days of receipt of the withdrawal notice.
(6) The customer shall bear the return costs.
(7) Opened or sealed goods which are not suitable for return for reasons of health protection or hygiene are excluded from withdrawal.
§ 7 Warranty
(1) The statutory warranty provisions pursuant to Sections 922 et seq. ABGB shall apply.
(2) Purogyn shall be liable for material defects existing at the time of delivery.
(3) Consumers are requested to check the goods upon receipt for completeness and obvious defects and to report any complaints immediately.
§ 8 Liability
(1) Purogyn shall be liable without limitation for damages resulting from injury to life, body or health.
(2) Purogyn shall only be liable for other damages in the event of intent or gross negligence.
(3) Liability for indirect damages, consequential damages or lost profits is excluded unless mandatory statutory provisions prevent this.
§ 9 Data Protection
Personal data is protected in accordance with the privacy policy at www.purogyn.com/datenschutz .
§ 10 Choice of law and place of jurisdiction
(1) Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) For consumers, the statutory place of jurisdiction pursuant to Section 14 of the Consumer Protection Act (KSchG) applies – i.e. the court at the customer’s place of residence.
(3) The place of performance is the registered office of Purogyn GmbH in Salzburg.
§ 11 Alternative dispute resolution
The European Commission provides a platform for online dispute resolution (ODR platform):

Purogyn is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
